Prime Minister Azad Jammu and Kashmir Sardar Tanvir Ilyas Khan has been disqualified by the full court of the AJK High Court for contempt of the apex judiciary .
The former Prime Minister AJK Tanvir Ilyas had criticized the judiciary two days ago for giving stay orders by the court on the funds of Rs 5.00 billion that were donated by Saudi Development Bank for the education sector in AJK.
In his speech on Sunday the Prime Minister AJK had raised questions on the court that why they interfere in almost every matter of the government and why stay orders for the long period are given by the courts against the development works initiated by the AJK government.
The Supreme Court as well as High Court of AJK had summoned Tanvir Ilyas on the charges of contempt of court on Tuesday (11th April). He personally appeared before the High Court.
The full bench under Justice Sadaqat Hussain Raja conducted the hearing against ex PM AJK,during which the video clips of his speeches were played.
Ex PM Sardar Tanvir Ilyas asked the court for granting him unconditional apology for his words against the judiciary by saying “I apologise unconditionally if any of my words hurt the judge.”
The court gave former AJK Prime Minister sentence till the adjournment of the court
The full bench of the High Court de-seated him from the membership of Legislative Assembly and ordered the Election Commission of AJK to hold elections on his seat .
A day earlier from appearing in the court ,when asked by the media about the notice from the court , Tanvis Ilyas said that “one of the leaders of teachers Qari Afraz has expired but the court issued stay orders in his case. Either if I quoted his example or talk about the stay order on Saudi funds then there is not any contempt of court. If I speak about the interference in day to day official affairs then there is not any contempt”, PM added.
During the hearing Justice Chaudhry Khalid Rasheed read out the judgement of the AJK High Court full bench, sentencing the AJK premier till the rising of the court.
The full bench said in its order that the matter was so serious that it was discussed in the judges’ council sitting, which decided unanimously that the matter could not be ignored as Tanvir committed a blunder by putting the authority of the courts on stake.
PTI leader Fawad Chaudhary reacted to the court’s decision . He said in his tweet message “this country cannot be run by destroying the judicial system,” he said, urging Ilyas to apologize and expressing the hope that he would be given relief by the SC. Fawad further stated that the Prime Minister Shehbaz Sharif should learn a lesson from the court’s decision.
The prompt action of the court astonished everyone as it looks like that the court took its verdict in some haste. Now the former PM AJK could knock the doors of Supreme Court for getting justice.
