Appointments of 5 judges of High Court declared null and void

MUZAFFARABAD: The appointments of 5 judges of Azad Jammu and Kashmir High Court declared null and void by the two members bench headed by the Chief Justice Azad Jammu and Kashmir Supreme Court, Raja Saeed Akram Khan here on Friday. The decision of 136 pages is written by the Chief Justice Raja Saeed Akram Khan. The concerned authority has been ordered to process the appointments of judges again in accordance with the renowned judicial case of Younis Tahir. Last year, a division bench of the Azad Jammu and Kashmir High Court (AJK HC) while dismissing petitions in judges’ appointment case declared that four judges appointed from the bar fulfilled the criteria to hold their offices. However, the fifth judge elevated from the bench did not meet the constitutional requirement of three years of service as district and sessions judge at the time of his elevation and hence ceased to hold office. The decision of High Court was appealed in the Supreme Court. Two members bench of Supreme Court heard the case in detail during last few days and preserved the decision which announced on Friday.
