It is the moral and religious obligation of any Muslim country including Pakistan to take the case of Israeli state terrorism against helpless Philistine to the International Court of Justice but when the “Ummah” failed to fulfil its responsibilities then a non -Muslim state South Africa came forward and realized its international duty towards humanity.
As a matter of fact, the Muslim “Ummah is divided into two major factions. Almost 95 percent of the masses that hail from first group from entire Muslim world are feeling pain in their hearts for their Philistines brethren but they are stranded and cannot take any practical measures except expressing sorrow because their rulers, who belong to second fraction are showing coward behavior like a frightened pigeon who covers its neck under earth when he sees any danger.
Though the monarchs and leaders of the Muslim countries disappointed their people, but they are content with the courage shown by South Africa to expose Israeli atrocities in Gaza through ICJ. We must admit her audacity. The rulers of the Muslim world have the fear that if they will act against Israel, then its old crony USA and super power may move against them to topple their government. They did nothing for the Philistine but some of them only condemned in very light words verbally only.
The hearing of South Africa’s case against Israeli war crimes and “ethnic cleansing in Gaza” was initiated in the International Court of Justice at The Hague, during which, representatives of South Africa were given the opportunity to present their evidence on this matter.
The hearing in the International Court of Justice will continue for two days, and today, Israel will also be given the opportunity to present its position. At the conclusion of the hearing, the court will decide whether an interim order should be issued on this matter or not.
On Thursday, South Africa accused Israel of violating the United Nations Convention on Genocide, stating that Hamas’s actions in October could not justify the genocide of Palestinians.
South Africa’s Minister of Justice, Ronald Lamola, stated, “Regardless of the severity of an armed attack on a sovereign territory, violations of the convention can neither provide justification for genocide nor be a defense.”
He told the court that Israel’s response to the October attacks has crossed the threshold of violating the convention against genocide.
South Africa’s advocate, Adila Hassim, stated in her arguments that the purpose of Israel’s bombing campaign is to destroy the lives of Palestinians and has forced Palestinians onto the brink of famine.
She stated, “There is never an explicit announcement of genocide, but this court has evidence of the past 13 weeks, which demonstrates (Israel’s) inconsistent behavior and its intentions, confirming reasonable claims of genocidal actions.On December 29, 2023, South Africa filed a case against Israel in the International Court of Justice (ICJ) seeking clarification on Israel’s apparent ethnic cleansing in Gaza during its crackdown on the Palestinian organization Hamas.
In this case, South Africa has demanded that the court take interim or provisional measures, including issuing an order to halt Israel’s military campaign in Gaza, proposing compensation for Gaza, and providing funds for reconstruction.
Following attacks on Gaza, South Africa, along with various countries worldwide, including Pakistan, has condemned Israel, calling for immediate international intervention and demanding Israel’s accountability.
South Africa’s position is that Israel’s actions in Gaza constitute crimes against humanity and war crimes, falling under the categories of mass killings, prevention of genocide, and violations of conventions related to punishment and prevention of the crime of genocide established in 1948.
